"Service" refers to the Neat Fastro platform, website, application, and AI-powered website generation tools.
"User" refers to any individual who accesses or uses our Service, including registered and unregistered users.
"Account" refers to a registered user profile on our Service.
"Content" refers to any websites, text, or other materials generated, uploaded, or shared through our Service.
"AI Model" refers to the artificial intelligence technology used to generate websites on our platform.
"Generated Websites" refers to the output created by our AI Models based on user inputs.
"Subscription" refers to a recurring payment plan that provides access to certain features of our Service.

To use certain features of our Service, you may need to create an account. You agree to provide accurate, current, and complete information during the registration process.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

You must be at least 18 years old to create an account. By creating an account, you represent and warrant that you are of legal age and have the capacity to enter into a binding agreement.

We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Our Service allows users to generate AI-powered headshots and photos based on user inputs. Users are responsible for all activities that occur under their account.

You may use our Service for personal or commercial purposes as permitted under your subscription plan. However, you may not:

• Use our Service in any way that violates any applicable laws or regulations
• Use our Service to generate content for fraudulent purposes, including deception or impersonation
• Automate access to our Service without our express written permission
• Attempt to bypass any rate limits or usage restrictions we impose
• Share your account credentials with others or allow others to access your account
• Redistribute, sell, or resell access to our Service without our authorization
• Use our Service in a manner that places excessive load on our infrastructure

We reserve the right to refuse service to anyone for any reason at any time, and to modify or discontinue any part of our Service with or without notice.

Ownership of Inputs: You retain all rights to the content you upload to our Service ("User Inputs"). By uploading User Inputs, you grant us a worldwide, non-exclusive, royalty-free license to use, site, and process these inputs solely for the purpose of providing and improving our Service.

Ownership of Generated Images: Users retain ownership of the images they generate using our Service, subject to the rights granted to us below and our underlying rights in our technology and AI Models.

License to AI Photos: By using our Service, you grant us a worldwide, non-exclusive, royalty-free license to:

1. Use your Generated Images to train, improve, and develop our AI Models and Service
2. Site, process, and display your Generated Images as necessary to provide our Service
3. Use your Generated Images for promotional purposes, unless you explicitly opt-out

Opt-Out: You may opt out of having your Generated Images used for promotional purposes by contacting us at privacy@example.com

Feedback: Any feedback, suggestions, or ideas you provide regarding our Service may be used by us without any obligation to compensate you.

You may not use our Service to create, upload, or share content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Depicts or promotes violence, discrimination, or hatred
• Contains sexually explicit material or pornography
• Infringes on intellectual property rights of others
• Violates privacy rights or portrays identifiable individuals without their consent
• Contains malware, viruses, or other harmful code
• Is designed to impersonate others or create fraudulent identities
• Manipulates or falsifies images with intent to spread misinformation
• Promotes illegal activities or violates any applicable laws

Additionally, you may not use our Generated Images to:

• Impersonate specific individuals without their consent
• Create fake profiles or identities intended to deceive others
• Generate content that could cause harm or confusion in high-stakes contexts (e.g., medical, financial, legal, or governmental contexts)
• Misrepresent AI-generated images as photographs of real people

We reserve the right to remove any content that violates these prohibitions and to suspend or terminate accounts engaging in prohibited activities.

Subscription Plans: We offer various subscription plans with different features and pricing. Details of current pricing are available on our pricing page.

Billing Cycle: Subscription fees are charged at the beginning of each billing period (monthly or annually). By subscribing, you authorize us to charge your payment method for the subscription fee on a recurring basis.

Free Trial: We may offer free trials of our subscription plans. At the end of a free trial, you will be automatically charged for the subscription unless you cancel before the trial ends.

Point Packages: We may offer one-time purchases of point packages that can be used to generate images. Points do not expire unless otherwise specified at the time of purchase.

Refunds: All fees are non-refundable unless otherwise specified in our refund policy or required by law. Cancellation of a subscription does not entitle you to a refund for the current billing period.

Price Changes: We reserve the right to change our fees at any time with reasonable notice. Any price changes will take effect at the start of the next billing period.

Taxes: You are responsible for any applicable taxes related to your use of our Service. All fees are exclusive of taxes unless stated otherwise.

Our IP: The Service, including its code, design, algorithms, AI Models, trademarks, and other content created by us, is owned by AI Photos and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our permission.

AI Models: Our AI Models and the technology used to generate images are our proprietary intellectual property. Your use of the Service does not grant you any rights to our underlying technology.

Generated Images: While you retain ownership of Generated Images as specified in Section 5, this ownership is subject to our underlying rights in our technology and AI Models. Your rights to use Generated Images depend on your subscription plan and these Terms.

Commercial Use: Depending on your subscription plan, you may use Generated Images for commercial purposes. However, you may not claim intellectual property rights in our AI Models or technology, even if used to create commercial content.

Attribution: We encourage, but do not require, attribution to "AI Photos" when you publish or share Generated Images in a public setting.

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using our Service, you agree to our data practices as described in the Privacy Policy.

Data Storage: We may site your User Inputs and Generated Images to provide and improve our Service. We implement reasonable security measures to protect your data.

Data Deletion: You may request deletion of your account and associated data by contacting us. However, we may retain certain information as required by law or for legitimate business purposes.

Usage Information: We collect information about how you use our Service for analytics, service improvement, and debugging purposes.

Team Accounts: Business or team subscriptions allow multiple users to access our Service under a single billing relationship. The account administrator is responsible for managing user access and ensuring all team members comply with these Terms.

Business Use: When using our Service on behalf of a business entity, you represent that you have authority to bind that entity to these Terms. The entity is responsible for all use associated with its account.

Enterprise Solutions: For custom enterprise solutions, additional terms may apply as specified in a separate agreement.

OUR SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not guarantee that our Service will be uninterrupted, timely, secure, or error-free, or that any Generated Images will meet your specific requirements or expectations regarding quality or accuracy.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AI PHOTOS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• YOUR USE OR INABILITY TO USE OUR SERVICE
• ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS OR PERSONAL INFORMATION
• ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SERVICE
• ANY BUGS, VIRUSES, OR OTHER HARMFUL CODE THAT MAY BE TRANSMITTED THROUGH OUR SERVICE
• THE CONTENT OR CONDUCT OF ANY THIRD PARTY ON OUR SERVICE
• ANY CONTENT OBTAINED FROM OR THROUGH OUR SERVICE

IN NO EVENT WILL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU HAVE PAID US IN THE PAST TWELVE MONTHS.

You agree to indemnify, defend, and hold harmless AI Photos and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:

1. Your use of our Service
2. Your violation of these Terms
3. Your violation of any third-party rights, including privacy or intellectual property rights
4. Your User Inputs or any content you submit to our Service
5. Your conduct in connection with our Service

Governing Law: These Terms shall be governed by and construed in accordance with the laws of If you own this site, please add this information, without regard to its conflict of law principles.

Arbitration: Any dispute arising from these Terms or your use of our Service shall be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

Class Action Waiver: Any proceedings to resolve disputes will be conducted on an individual basis. Neither you nor we may join or consolidate claims by or against other users, or litigate any claim as a class representative.

Informal Resolution: Before initiating any formal dispute resolution proceeding, you agree to attempt to resolve the dispute informally by contacting us at neatfastro@gmail.com.

We may modify these Terms at any time. We will provide notice of material changes by posting the revised Terms on our website or via email. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

By You: You may terminate your account at any time by following the instructions on our website or contacting us.

By Us: We may terminate or suspend your account or access to our Service immediately, without notice, if we believe that you have violated these Terms.

Effects of Termination: Upon termination, your right to use the Service will immediately cease. Any provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Entire Agreement: These Terms constitute the entire agreement between you and AI Photos regarding our Service and supersede all prior agreements.

Severability: If any provision of these Terms is found to be unenforceable, that provision will be limited to the minimum extent necessary so that these Terms will otherwise remain in effect.

No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.

Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms at our discretion without restriction.

Force Majeure: We will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control.
